Overview

Why Visa Condition 8107: Work Limitation Explained?

Information checked 31 October 2026.

Condition 8107 is on visas granted so the holder can work for a particular employer or do specific activities in Australia. If employed, the holder must not stop working for that employer, and must not work in a different position or occupation, for another employer, or for themselves.

Work rights and key limits

  • If employed, the holder must not stop working for their employer.
  • They must not work in a different position or occupation, with another employer, or for themselves.
  • If the visa was granted for an activity, they must not stop doing that activity or do unrelated activities.

What to check before they start

  1. If a worker's grant shows condition 8107, confirm the visa was granted for work with your business before they start.
  2. Do not move the worker into a different position or occupation without checking what their visa allows.
  3. With the worker's consent, check their visa and its conditions through VEVO before they start, and keep the result on file.
  4. It is against the law to hire a non-citizen who does not hold a valid visa, or to have them do work that goes against their visa conditions.

RefChecks runs a Right to Work check through VEVO: the worker gives consent and their details, and you get their visa, its conditions and expiry in their report. Related: condition 8607, Skills in Demand visa (subclass 482).
