1. Acceptance of Terms

By accessing or using Refchecks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Refchecks is a reference checking platform that enables organizations to request, collect, and manage employment references. The Service includes features for creating reference requests, collecting responses from referees, and generating reports.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 16 years of age
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. User Responsibilities

When using the Service, you agree to:

  • Use the Service only for lawful purposes
  • Obtain appropriate consent from individuals before collecting their personal data
  • Not use the Service to discriminate against any person based on protected characteristics
  • Not attempt to access data belonging to other organizations
  • Not interfere with or disrupt the Service or its infrastructure

5. Organization Accounts

Organizations using the Service are responsible for managing their users and ensuring compliance with applicable laws. Organization administrators can add, remove, and manage user access within their organization.

6. Data Ownership

You retain ownership of all data you submit to the Service. By using the Service, you grant us a license to store, process, and display your data as necessary to provide the Service.

7. Referee Consent

When a referee submits a reference through the Service, they consent to sharing their responses with the requesting organization. Referees may also optionally consent to anonymized use of their data for fraud detection purposes.

8. Intellectual Property

The Service, including its design, features, and content (excluding user data), is owned by Refchecks and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

9. Payment Terms

Certain features of the Service require a paid subscription. Payment terms, pricing, and billing cycles are specified at the time of purchase. Subscriptions renew automatically unless cancelled.

10. Limitation of Liability

To the maximum extent permitted by law, Refchecks shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may terminate your account at any time by contacting us or using the account deletion feature.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Refchecks is incorporated. Any disputes shall be resolved in the courts of that jurisdiction.
