Overview

Why Skilled Independent Visa (Subclass 189): Work Rights for Employers?

Information checked 31 October 2026.

The Skilled Independent visa (subclass 189) is a permanent visa for invited skilled workers. Home Affairs says it lets holders live and work permanently anywhere in Australia, and they become permanent residents on the day the visa is granted.

Work rights and key limits

  • It is a permanent visa. The holder becomes a permanent resident on the day it is granted.
  • The holder can live and work permanently anywhere in Australia.

What to check before they start

  1. Confirm the visa is a subclass 189 with a check of the worker's visa, and keep the result on file.
  2. With the worker's consent, check their visa and its conditions through VEVO before they start, and keep the result on file.
  3. It is against the law to hire a non-citizen who does not hold a valid visa, or to have them do work that goes against their visa conditions.

RefChecks runs a Right to Work check through VEVO: the worker gives consent and their details, and you get their visa, its conditions and expiry in their report. Related: Partner visa (temporary) (subclass 820), Skills in Demand visa (subclass 482).
